Terms and Conditions

These Terms and Conditions (“Terms”) constitute a legally binding agreement between TRADEMARCON INVEST, a company registered in Romania, VAT No. RO45160460, with its registered office at Comuna Filipeștii de Târg, Sat Brăteșanca, Strada Principală, Nr. 83, Camera 1 (“NodeCoast” or “Provider”) and any individual or entity accessing or using the services offered via nodecoast.com, hosting.nodecoast.com or any associated subdomains (collectively, the “Services”).

By accessing our websites or using any NodeCoast service, including but not limited to web hosting, domain registration, email hosting and related technical support, you (“Client” or “User”) agree to be bound by these Terms. Continued use of the Services constitutes full acceptance of these Terms, including any future amendments published on our website.

 

1. Data Protection & GDPR Compliance

NodeCoast processes personal data in strict compliance with Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR) and applicable Romanian data protection laws. Personal data collected is used solely for the purpose of delivering contracted services, processing orders, billing and facilitating communication with the Client.

Clients retain all rights granted under GDPR, including:

  • Right of access
  • Right to rectification
  • Right to erasure (“right to be forgotten”)
  • Right to restriction of processing
  • Right to data portability
  • Right to object
  • Right to complain to the Romanian Data Protection Authority (ANSPDCP)

To exercise any of these rights, Clients must submit a written request to: office@nodecoast.com.

2. Prohibited Content & Activities

The following content and activities are strictly prohibited on any infrastructure managed or provided by NodeCoast:

  • Material that infringes intellectual property rights or other legal protections
  • Obscene, pornographic, violent, discriminatory or defamatory content
  • Malware, viruses, trojans, ransomware or any malicious code
  • Pirated software, illegal streaming platforms or fraudulent schemes
  • Cryptocurrency mining scripts, crypto exchanges or digital wallets
  • Torrent trackers, file-sharing platforms or P2P applications
  • Adult content, spam bots, phishing tools or phishing pages
  • Proxy/anonymization services, IRC networks or resource-intensive scripts (e.g., topsites, chat rooms, mail bombers)

 

Use of server resources exclusively for storage or media broadcasting (e.g., video/audio streaming, image hosting, online radio)

Violation of this policy will result in immediate suspension of the affected account without prior notice. No refunds will be issued for accounts terminated due to policy violations.

3. Account Security & Client Responsibilities

Clients are solely responsible for:

  • Keeping all software (CMS, plugins, custom scripts) up to date
  • Securing their cPanel, FTP, email, and database credentials
  • Scanning and removing malware from their accounts
  • Enabling Two-Factor Authentication (2FA) wherever available

 

NodeCoast is not liable for security breaches resulting from outdated software, weak passwords or compromised client credentials. Infected accounts may be IP-restricted until cleaned. Failure to remediate within 48 hours may result in permanent suspension.

Clients are encouraged to use the Imunify360 security suite (available in cPanel) for malware detection and removal.

4. Server Resource Usage Policy

To ensure optimal performance for all clients, the following resource limits apply to shared hosting environments:

  • CPU Usage: Maximum 5% sustained average
  • Memory (RAM): Maximum 5%
  • MySQL Load: Maximum 1.5%
  • Individual Processes: Must not exceed 10% CPU at any time

 

Resource consumption is continuously monitored via cPanel > Resource Usage. Accounts exceeding these thresholds may be suspended without notice. Temporary resource upgrades may be requested via support ticket, subject to availability.

Cron jobs must be scheduled no more frequently than once every 10 minutes.

5. Email Policy

Bulk or unsolicited commercial email (SPAM) is strictly prohibited. Each hosting account is limited to 300 outbound emails per hour. Violations will result in immediate account suspension without refund.

Email lists must be opt-in only and all messages must include a clear unsubscribe mechanism. Strong passwords (including uppercase, numbers and special characters) are required for all email accounts. Passwords should be rotated every 6 months.

6. Backups

NodeCoast provides automated backups via JetBackup stored in secure data centers in Germany. Backups are retained on a 10-day rotation and are accessible free of charge via cPanel.

However, clients are ultimately responsible for maintaining their own off-server backups. NodeCoast does not guarantee backup integrity or recovery success. In the event of account deletion due to non-payment beyond 30 days, restoration from backup is available for a fee of €100 + VAT, payable only upon successful recovery.

7. Limitation of Liability

NodeCoast shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Data loss due to client error, hacking or third-party software
  • Service interruptions caused by upstream providers, CDN failures, payment processors or domain registrars
  • Cyberattacks (e.g., DDoS), war, terrorism or natural disasters

 

In no event shall NodeCoast’s total liability exceed the amount paid by the Client for the relevant service during the preceding 12 months.

8. Force Majeure

NodeCoast is not liable for failure or delay in performance due to circumstances beyond reasonable control, including but not limited to:

  • Natural disasters
  • War, terrorism, or civil unrest
  • Government actions or embargoes
  • Internet or power outages
  • Cybersecurity incidents (e.g., DDoS attacks)
  • Critical security patches or emergency maintenance

 

Such events suspend obligations under these Terms for their duration.

9. Payments & Billing

All services require advance payment. Invoices are issued in EUR at the exchange rate of the National Bank of Romania (BNR) on the invoice date.

Failure to pay within 10 business days of invoice issuance will result in service suspension. Reactivation requires full payment of all outstanding amounts.

Domain registration fees, VPS/dedicated server fees, cPanel licenses and reseller services are non-refundable.

10. Money-Back Guarantee

New shared hosting clients are eligible for a 30-day money-back guarantee, provided:

  • It is the Client’s first order with NodeCoast
  • No more than 5 complex support tickets (>5 hours total effort) have been submitted
  • No manual migrations, advanced optimizations or policy violations have occurred

 

Refunds are processed via bank transfer within 14 days of approval. The guarantee does not apply to domains, VPS, dedicated servers or add-on services.

11. Termination

Either party may terminate services with 30 days’ written notice. NodeCoast reserves the right to terminate services immediately for violations of these Terms.

Upon termination, Clients must export all data before account deletion. NodeCoast will assist with a smooth transition, but is not obligated to retain data beyond the standard backup window.

12. Communications & Notices

Official communications will be sent to the email address on file in the Client’s billing account. It is the Client’s responsibility to keep contact details accurate and up to date.

NodeCoast may also send service-related announcements or promotional offers deemed relevant to the Client’s use of the platform.

14. Governing Law and Jurisdiction

By accessing or using the NodeCoast websites, you agree that these Terms and Conditions, as well as any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of Romania.

In the event of any disagreement between you and TRADEMARCON INVEST, the parties shall first attempt to resolve the matter amicably. If no resolution is reached within 30 days, the dispute shall be submitted to the competent courts of Prahova County, Romania, which shall have exclusive jurisdiction.

15. Intellectual Property and Website Content

All content published on the websites nodecoast.com and hosting.nodecoast.com, including but not limited to text, images, graphics, logos, icons, audio/video files, email templates, scripts, software code, databases and any other materials, is the exclusive property of NodeCoast and is protected under Romanian Law No. 8/1996 on Copyright and Related Rights, as well as under applicable national and international intellectual and industrial property laws.

Any unauthorized use, reproduction, distribution, transmission, display, modification or commercial exploitation of the aforementioned content (whether in whole or in part) is strictly prohibited without the prior written consent of NodeCoast. Such actions constitute a violation of intellectual property rights and may result in civil or criminal liability under applicable law.

Should you believe that your intellectual property rights have been infringed by content hosted or published on our websites, please notify us immediately at office@nodecoast.com

Except as expressly permitted by law (e.g., private copying for personal use), no content from these websites may be extracted, reused, sold, licensed or otherwise commercially exploited without the explicit prior written authorization of the rights holder.

Unless otherwise stated, all names, logos, trademarks, service marks, trade names and domain names used on the NodeCoast websites are the property of TRADEMARCON INVEST and may not be used by any third party for any purpose without our prior written permission.

17. Amendments and Accessibility

NodeCoast reserves the right to modify these Terms and Conditions at any time, without prior notice. Changes will become effective immediately upon publication on the websites. It is your responsibility to review this page periodically for updates.
